By accessing or using the Clearvoyance.ai platform, website, applications, APIs, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("you", "your", or "User") and Clearvoyance.ai ("Clearvoyance", "we", "us", or "our"). If you do not agree to these Terms, you must not access or use the Service.

Service Description

Clearvoyance provides a feedback collection and research platform that may include, without limitation, the creation and management of campaigns, collection of written and audio responses, incentive and reward mechanisms, cryptographic or blockchain-based escrow systems, AI-assisted insights, and related communications. The Service is provided on an "as is" and "as available" basis. Clearvoyance reserves the right to modify, suspend, or discontinue any aspect of the Service.

Eligibility

You represent and warrant that you are at least eighteen (18) years of age, have the legal authority to enter into this agreement, and will use the Service in compliance with all applicable laws and regulations. Clearvoyance does not knowingly provide services to minors.

Account Responsibility

Certain features of the Service may require account creation or authentication. You are solely responsible for maintaining the confidentiality of your credentials and for all activity occurring under your access. Clearvoyance is not responsible for unauthorised access resulting from your actions or omissions.

An API key is the account. Anyone who holds the key can use the account and spend its balance, so keep it secret and treat it like a password. Clearvoyance stores only a one-way hash of the key and cannot show it to you again. If you believe a key has been exposed, contact us and we will revoke it.

Campaign Creator Responsibilities

If you create or manage a campaign, you acknowledge that you are solely responsible for the campaign's content, structure, legality, and purpose. You agree not to use the Service for unlawful, deceptive, discriminatory, abusive, or unethical activities. Clearvoyance does not review, endorse, or validate campaign content and disclaims responsibility for campaign outcomes, participant behaviour, or compliance with employment, consumer, privacy, or labour laws.

Prepaid Balance

An account may hold a prepaid balance, used to pay for campaigns. A balance is credit for the Service, recorded in US cents. It is not a deposit or savings account, earns no interest, cannot be transferred to another account, and does not expire.

You add to a balance by card, processed by Stripe. We credit the amount we actually receive. Clearvoyance does not hold crypto as a balance: crypto stays in your own wallet until you fund a specific campaign.

A campaign paid from a balance costs the listed price for its size, the same price list that applies on our website. The whole price is charged when the campaign launches, whatever the campaign receives, and is not refunded if it receives fewer answers than its size or is closed early.

Credit given free of charge, including sandbox (test) credit, has no cash value and is not refunded.

Refunds

Unused credit stays in your balance for your next campaign. It is refunded when you close your account. You can close an account through the API, or by contacting [email protected]. Any campaign still running must close first. We will never ask you to send us your API key.

A refund goes back only to the card that paid, through Stripe, less the processing fee Stripe does not return to us, and never to a different card, bank account or wallet. Card refunds usually appear within 5 to 10 business days. If a card refund is refused, for example because the card has been cancelled, the amount stays in your balance as credit and we will contact you if we have a way to.

If we suspend or terminate an account for any reason other than fraud or a breach of these Terms, we will refund its unused balance in the same way.

Participants

Participants provide responses voluntarily. Clearvoyance does not guarantee the quality, accuracy, or honesty of responses. Participants are not employees, contractors, or agents of Clearvoyance. Clearvoyance makes no representations regarding participant conduct or the usefulness of collected responses.

Rewards and Blockchain

The Service may facilitate incentive or reward mechanisms, including blockchain-based payouts. You acknowledge that all such mechanisms are used at your own risk. Wallet addresses must be supplied accurately. Clearvoyance never creates a wallet for you and never holds your wallet's keys: you pay from, and receive rewards to, a Solana address you control. Each reward-paying campaign gets its own escrow wallet, so no single wallet ever holds everyone's rewards. Clearvoyance holds that escrow's keys, encrypted, and the escrow pays a reward only after a participant's submission succeeds. Clearvoyance does not guarantee the availability or security of blockchain networks. Blockchain transactions are irreversible. Clearvoyance is not responsible for incorrect wallet addresses, lost or inaccessible funds, or network failures.

Unclaimed Rewards

Participants have 30 days after a campaign ends to claim their rewards, and are told the date when they finish the survey. After that the claim window is closed and a reward can no longer be claimed. Whatever is unclaimed then belongs to the campaign creator and is sent back automatically to the refund wallet the creator gave when funding the campaign. A campaign funded without a refund wallet keeps its unclaimed rewards in its escrow, where the creator can still withdraw them. Clearvoyance never moves unclaimed rewards into its own treasury.

Third-Party Services

The Service relies on third-party providers, including but not limited to blockchain networks, payment processors, email delivery services, AI providers, and infrastructure vendors. Clearvoyance is not responsible for the availability, security, or actions of third-party services. Your use of third-party services is governed by their respective terms and policies.

AI-Assisted Features

Certain features may utilise automated systems or artificial intelligence. AI-generated outputs are probabilistic and may be inaccurate or incomplete. Such outputs are provided for informational purposes only. You remain solely responsible for decisions made based on AI-assisted insights. Clearvoyance makes no guarantees regarding accuracy, suitability, or fitness for any particular purpose.

Prohibited Conduct

You agree not to attempt to identify, deanonymise, or correlate responses to individuals; abuse incentives or rewards; scrape, reverse engineer, attack, or interfere with the Service; use the Service for spam, fraud, or unlawful purposes; or otherwise misuse the platform. Clearvoyance reserves the right to suspend or terminate access at its sole discretion.

Beta Features

Certain features may be offered in beta, pilot, or experimental form. Such features may be unstable, incomplete, or subject to change without notice and are used entirely at your own risk.

Intellectual Property

All intellectual property rights in the Service, including software, branding, and platform content, are owned by Clearvoyance or its licensors. Users retain ownership of content they submit but grant Clearvoyance a worldwide, non-exclusive, royalty-free license to operate, maintain, and improve the Service.

Disclaimer of Warranties

To the maximum extent permitted by law, Clearvoyance disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Clearvoyance shall not be liable for indirect, incidental, consequential, or punitive damages. Clearvoyance's total liability shall not exceed the fees paid to Clearvoyance in the twelve (12) months preceding the claim.

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.

Indemnification

You agree to indemnify and hold harmless Clearvoyance from any claims, liabilities, damages, losses, or expenses arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

Termination

Clearvoyance may suspend or terminate your access at any time, with or without notice, for any reason. Provisions that by their nature should survive termination shall survive.

Governing Law

These Terms are governed by and construed in accordance with the laws of Australia without regard to conflict-of-law principles.

Changes to Terms

Clearvoyance may update these Terms at any time. Continued use of the Service constitutes acceptance of the updated Terms.
